DACA “Dreamers” Considering FHA Loan Eligibility

The Department of Housing and Urban Development (HUD) announced on Tuesday that it had Extended eligibility for FHA mortgages to people classified under the Deferred Action for Childhood Arrivals (DACA) program. These individuals are perhaps better known as “Dreamers”. DACA status is granted to undocumented people who were brought into the country before their 16th birthday.e birthday and were under the age of 31 when the category was created on June 15, 2012. Residence requirements apply and individuals must be in school, have completed high school, obtained a GED certificate or be discharged honorably from one of the military services. DACA status allows its holders to work legally in the United States and prevents their involuntary expulsion from the country for a renewable period of two years.

Ahead of the HUD announcement, the FHA Single Family Housing Handbook states, “Non-US citizens without legal residency in the United States are not eligible for FHA insured mortgages. entered the United States legally but nonetheless be legally present. This clause is deleted as of January 19, 2021.

DACA applicants must comply with all other FHA mortgage requirements that include purchasing a property as a primary residence, possessing a valid Social Security number (although there is exceptions for persons employed by certain foreign entities) and possessing documents certifying eligibility to work in the United States
